Dr. Stefan Eichhammer and Felix Grosse successful in front of the Higher Regional Court of Hamburg and EUIPO in “DropStop” trademark dispute

With final decision issued on January 18, 2018, the European Intellectual Property Office (EUIPO) retroactively cancelled the “DropStop” trademark (No. 7 448 012), which is particularly well-known among wine connoisseurs. The EUIPO followed our view that the contested mark lacks any distinctive character. The cancellation proceedings has been triggered by an infringement suit brought by the trademark owner before the Regional Court of Hamburg.
