Already 2 weeks ago I described a case related to bicycle technology. Today I would like to present the second case, which has remained in my memory as a highlight:
A nullity action by a competitor against another one of our client´s European patents (German national part)
This whole matter started with a nullity action in the year 2010 when another competitor of our client attacked one of our client’s patents. This patent and its claimed subject-matter was of major importance for our client as the underlaying technology defined a new overall standard for mounting the cranks to a bicycle, either to a mountain bike or road racing bike, thus providing a new lightweight and robust solution. Four years later, we again managed to convince the German Supreme Court of our position and achieved a 100 % victory. Also in this case, it was a great feeling to accomplish this together with the expert support of our client´s patent division and to be able to celebrate the success with them.
